SpaceXAI sues Minnesota over new ban on AI-generated nude images

SpaceXAI has filed a lawsuit challenging Minnesota's upcoming law that would prohibit apps creating nonconsensual intimate images and impose heavy fines on developers.

SpaceXAI, the merged entity of Elon Musk's AI ventures, has taken legal action against Minnesota Attorney General Keith Ellison to block a law slated to take effect in August that bans applications capable of producing nonconsensual intimate images and levies $500,000 fines per violation. In its complaint, the firm contends the legislation is an overreaching, content-based limitation on free speech that extends beyond the intended protection against deepfake abuse.

Although SpaceXAI says it prohibits generating nude images without consent and has pursued users who bypass its safeguards, it warns the new penalties would compel it to severely limit the image-editing functions of its Grok model. The company asks the court to rule the statute unconstitutional and halt its enforcement. Minnesota officials, including Governor Tim Walz, have responded by emphasizing the dignity-harm caused by AI-generated nudification and asserting the law's necessity.

Why it matters

The case could shape how states regulate AI tools that create nonconsensual sexual imagery.

How the sides frame it

HIGH AGREEMENT

All camps focus on xAI's lawsuit challenging Minnesota's ban as a First Amendment issue, with minor wording differences but no substantive disagreement.

LEFT

Frames the lawsuit as a last-minute scramble to stop an overbroad law that threatens free speech after prior deepfake abuse.

CENTER

Frames the law as an overreaching, content-based restriction that could force the company to curtail its image-editing features despite its safeguards.

RIGHT

Frames the law as a clumsy, overly broad measure that infringes free speech and would hold the company liable even if it blocks nudification.

The left emphasises

  • last-minute scramble to stop Minnesota’s anti-nudification app law
  • law violates the First Amendment
  • Grok flooded the internet with millions of sexually explicit deepfakes

The right emphasises

  • law is "clumsy" and overly broad
  • violates the First Amendment right to free speech
  • holds xAI strictly liable even if it prohibits nudification
