1MDB seeks Federal Court approval to revive lawsuit against White & Case
1MDB's counsel says the Federal Court has set a hearing and ordered written submissions by late September as the fund tries to overturn the dismissal of its case against White & Case.
According to lawyer Lim Zhi Ying, the Federal Court scheduled a hearing and required written submissions and authority bundles by 28 September. 1MDB has raised 26 legal questions concerning jurisdiction and the possibility of consolidating its claim, aiming to secure the court's permission to proceed. The Court of Appeal previously permitted White & Case to overturn the suit, finding that the service of court documents abroad did not satisfy the requirements of the 1964 Court of Judicature Act and the 2012 Rules.
Judge K Muniandy noted that Patrick Mahony, residing overseas, could not be regarded as the principal defendant, and that the claim was filed beyond the six-year limit set by the Limitation Act 1953. He also dismissed 1MDB's attempt to combine the lawsuit with a separate action against Deutsche Bank, describing it as a tactical ploy. 1MDB alleges fraud and conspiracy by White & Case and PetroSaudi director Mahony, seeking compensation, and had earlier secured a High Court ruling that Malaysia was the appropriate forum for the dispute.
