AFGE asks judge for provisional order to revive VA labor contract
The American Federation of Government Employees has petitioned a federal judge for an “indicative” ruling that would restore its collective bargaining agreement with the Veterans Affairs Department, pending approval from the First Circuit Court of Appeals.
The American Federation of Government Employees submitted a motion asking U.S. District Judge Melissa DuBose to issue an “indicative” ruling that would revive its collective bargaining agreement with the Veterans Affairs Department, contingent on a future First Circuit decision. This follows a First Circuit panel’s finding that DuBose’s earlier injunction had been improperly modified after the VA announced the contracts would expire in August.
AFGE maintains that a renegotiation clause triggered an automatic extension of the contract, whereas the VA claims the union did not commence bargaining within the statutory 30-day window. The union also lodged a national grievance alleging bad-faith bargaining by VA management. In its response, the VA objected to a rushed briefing schedule and emphasized that any indicative ruling would merely signal to the appellate court what the district court might do, without immediate effect.
Why it matters
The outcome will determine whether federal workers at the VA retain collective bargaining protections during ongoing contract negotiations.
