Appeals Court Affirms Sentence for Human Smuggler Linked to 2022 Border Tragedy
The U.S. Court of Appeals for the Eighth Circuit upheld Harshkumar Patel's conviction and ten-year sentence for coordinating the smuggling that led to a four-person Indian family freezing to death near the Manitoba-U.S. border.
The United States Court of Appeals for the Eighth Circuit ruled that the evidence was sufficient to sustain Harshkumar Patel's guilty verdict and more than ten-year prison term for orchestrating a human-smuggling operation that ended in the deaths of Jagdish Patel, his wife Vaishali, and their children Vihangi and Dharmik, who froze in a Manitoba field in January 2022. Patel's arguments that the district court misapplied sentencing enhancements, that the charges were duplicitous, or that the convictions conflicted were all dismissed as lacking merit.
The panel noted that Patel had not preserved these issues for appeal. He had been arrested in Chicago in 2024 and was found to have hired Florida resident Steve Shand to drive the migrants after they entered Minnesota. A separate appeal for Shand will be heard in St. Paul on October 23. Upon completing his sentence, Patel is expected to be deported to India.
