Austrian Court Challenges Extended 80 km/h Zone on A2 Near Wiener Neudorf

The Lower Austrian Administrative Court has asked the Constitutional Court to overturn the 80 km/h speed limit on the A2 near Wiener Neudorf, arguing it exceeds the area justified by a noise study.

A driver caught exceeding the 80 km/h limit on the A2 near Vösendorf in December 2025 challenged the fine, claiming the speed zone extended beyond the portion identified in a noise impact study. The Lower Austrian Administrative Court has now petitioned the Constitutional Court to declare the entire speed ordinance invalid, stating that the extension was a temporary measure tied to existing traffic control equipment and was never scientifically justified.

The 80 km/h limit, introduced by the transport ministry under former minister Leonore Gewessler in December 2024 to shield nearby residents from noise, also affects the 100 km/h limit set in the same regulation. The court argues that the authorities did not adequately assess whether the broader restriction is necessary or proportionate. FPÖ officials welcomed the challenge, calling the speed limit an unnecessary hindrance for commuters. The driver’s appeal will proceed once the court rules on the ordinance’s legality.

Why it matters

It could reshape speed limits on a major Austrian highway, affecting commuter travel and local noise policy.
