Berlin renters pay up to double the legal rent limit, study shows

A new rental atlas reveals that tenants across Berlin are paying, on average, 60% more than the rent ceiling set by the Mietspiegel, with the highest overcharges in central districts.

Allright’s 2025 rental atlas, based on a review of numerous genuine rental agreements, indicates that Berlin tenants are on average paying 60% above the Mietspiegel ceiling. The overpayment is pervasive across all twelve districts, but is especially pronounced in central neighborhoods and in apartments of 40 sqm or less, where the price per square metre exceeds the legal cap by about €9. In Charlottenburg-Wilmersdorf, renters face the steepest surcharge, paying €14.52 per square metre - 111% of the permitted rate.

Friedrichshain-Kreuzberg follows, with average rents of €15.93 per square metre, more than double the legal limit of €7.63. Mitte, Marzahn-Hellersdorf and Lichtenberg also show significant gaps, ranging from 57% to 86% over the index. The report highlights that single occupants and students are particularly vulnerable to these illegal price hikes. Tenants suspecting overpayment are advised to contact Berlin’s Rent Review Office for assistance.
