Bombay High Court revokes bail for Luthra brothers and Agay Gupta in Arpora fire case

The Bombay High Court cancelled bail for Saurabh Luthra, Gaurav Luthra and Agay Gupta, ordering them to surrender within two weeks.

In a Tuesday ruling, the Bombay High Court withdrew the bail previously granted to Birch by Romeo Lane co-owners Saurabh Luthra, Gaurav Luthra and Agay Gupta, directing them to surrender within two weeks and permitting fresh bail petitions. Justice Neela Gokhale instructed the trial court to decide any new applications within the same timeframe. The state had contested the lower court's decisions, arguing that the accused left the country or the state after the deadly Arpora nightclub fire that claimed 25 lives.

Prosecutors highlighted the club's lack of fire safety measures and illegal construction, while the defendants blamed an event company for the blaze. Earlier bail grants had been issued in both the fire and a related forgery case, but the high court found the circumstances warranted revocation.

Why it matters

The decision reinstates custody of key suspects in a tragedy that killed 25, reflecting judicial response to public safety failures.
