Brazil tightens AI rules as presidential election approaches amid synthetic fake avatars

Brazil's Superior Electoral Court has imposed labeling and impersonation bans on AI-generated political content ahead of the Oct. 4 vote, citing the rise of hyperreal avatars like the synthetic commentator “Dona Maria.”

In preparation for Brazil's presidential election on Oct. 4, the Superior Electoral Court enacted comprehensive regulations targeting artificial-intelligence-generated political content. The rules mandate explicit labeling of AI-produced material and prohibit the use of AI to impersonate any candidate. Civil-society monitors identified 29 instances of AI avatars, the most prominent being “Dona Maria,” a hyperreal Black woman who amassed millions of views criticizing President Luiz Inácio Lula da Silva’s policies.

Lula’s coalition filed a lawsuit seeking the removal of her profiles, arguing they spread misleading information. Scholars and NGOs stress that such synthetic personas can build rapport and influence voter perceptions, while the court also bans AI tools from ranking candidates or expressing opinions during a 72-hour blackout surrounding the vote. Despite platform takedowns, secondary accounts persist, highlighting enforcement challenges. The situation serves as a test of Brazil’s ability to police AI in a highly polarized, online-savvy electorate.
