CGPJ launches disciplinary case against Judge David Maman after gender-bias remarks

During a training session organized by the Colegio de Abogados de Madrid, judge David Maman claimed that women who report gender-based violence receive free legal aid and are presumed to be trustworthy, implying a systemic advantage. The Promotor of the Disciplinary Action initially sought to close the investigation, citing freedom of expression. In the CGPJ’s permanent commission, four PP-appointed members voted to archive the case, while three members from PSOE and Sumar voted to proceed.

President Isabel Perelló exercised her quality vote, tipping the balance toward opening a disciplinary file for alleged disrespect. Dissenting councilors maintained that judges, as citizens, enjoy free speech and that Maman’s remarks were made outside any active proceeding and did not infringe on confidentiality or privacy, thus falling within protected expression.
