Constitutional Court annuls specific solidarity contribution rules for Budaörs

Budaörs had challenged the way its solidarity contribution was calculated, arguing it paid more to the central budget than it received in support. The Constitutional Court ruled that the 2024 amendment, introduced by the Orbán government, improperly excluded the General Administrative Procedure Act from the contribution determination process. By eliminating the finance minister's evaluative role and the ministerial decree that fixed each municipality's amount, the court removed the unique administrative procedure previously applied to Budaörs.

Moreover, the court declared the clause authorising the treasury minister to set contribution levels by decree unconstitutional. The judgment invalidated only the Budaörs-specific line in the law's annex, while the broader legislation and related decree remain in force until the end of the year. A dissenting judge warned that the unchanged obligations for other municipalities could cause problems.
