Constitutional Court President forwards judges' oath dispute to disciplinary office

The president of the Constitutional Tribunal sent a letter from eight newly appointed judges to the disciplinary spokesman for review, contesting the handling of their oath ceremonies.

Eight judges selected by the Sejm submitted a joint declaration asserting that all of them should be allowed to sit on the Constitutional Tribunal without delay. They argue that the Constitution assigns the selection of judges solely to the Sejm, not the president, and that inviting only a subset of appointees to the presidential palace constituted an arbitrary selection process. Three judges—Bentkowska, Patyra and Szostek—took their oath in the presence of the parliamentary speaker, while the others swore before the president in parliament.

The Tribunal president, however, does not recognize oaths administered in the Sejm as effective and has forwarded the judges' letter to the disciplinary spokesman for examination. The disciplinary inquiry, launched earlier, also investigates alleged criminal suspicions involving Tribunal staff and the judges' refusal to participate in General Assembly sessions, potentially leading to disciplinary charges.

Why it matters

The dispute could affect the functioning and independence of Poland's highest constitutional court.
