Council of the Judiciary rejects Rachida Dati's proposed senior justice ministry role

The Conseil supérieur de la magistrature issued a negative opinion on Rachida Dati's appointment to a senior position in the justice ministry, a role suggested by the Chancellerie.

The Chancellerie proposed Rachida Dati for the position of premier substitute in the central administration of the justice ministry, tasked with missions at the European and international affairs delegation. The Conseil supérieur de la magistrature responded with an unfavorable opinion, effectively blocking the appointment. This development follows Dati's recent summons to a Paris correctional tribunal on accusations of passive corruption and passive influence peddling in the Renault-Ghosn affair.

The council argued that her involvement in ongoing criminal proceedings makes it problematic to place her in a senior international role where she might represent France and handle European cases. The ministry has not yet announced a replacement. The outcome also reflects on Justice Minister Gérald Darmanin, who oversaw the ministry during the nomination process.

Why it matters

The rejection highlights concerns about judicial independence when officials under criminal investigation seek senior legal positions.
