Court Allows Appeal on Massive 1MDB Judgment Involving Jho Low and Father

A three-judge panel of the Court of Appeal has granted permission to revisit the USD-denominated judgment against Jho Low and his father, ordering the case to be heard by another High Court judge.

A three-judge Court of Appeal panel, led by Judge Azhahari Kamal Ramli and joined by Judges Ahmad Kamal Shahid and Alice Loke, approved an appeal concerning the judgment against Jho Low and his father, Larry Low Hock Peng. The panel instructed that the appeal be heard by a different High Court judge and made no ruling on legal costs. This development follows a Kuala Lumpur High Court ruling that dismissed a petition by five companies seeking to overturn the earlier judgment, which was issued after the Low duo violated a Mareva injunction.

The original judgment required the Low family to pay a substantial sum with 5% annual interest calculated from the early 2010s onward. Representation for 1MDB and its subsidiaries was provided by lawyer Lee Shih, assisted by Priyadana Annadurai, while the Low family were unrepresented in court.

Why it matters

The decision could alter a multi-billion-dollar liability tied to the 1MDB scandal.
