Court battle over gas contract disputes could set precedent for energy consumers

A lawsuit filed by LitFin on behalf of thousands of Skautská energie customers seeks compensation from Kolibřík Energie after abrupt supply cuts during the energy crisis.

In 2020, Barbora Jáčová entered a gas agreement with Kolibřík Energie via the Skautská energie intermediary, which matched consumers with low-price suppliers. After the energy crisis escalated, Kolibřík abruptly stopped deliveries in October 2021, forcing its clients into a statutory “last-instance” supply scheme with substantially higher tariffs. Jáčová’s household incurred significant additional expenses and had to limit heating.

LitFin, a financing firm that supports large legal actions, now represents about three thousand Skautská energie customers covering six thousand delivery points, seeking compensation and contract penalties from Kolibřík. The dispute is notable because Kolibřík was declared insolvent in December of the previous year and holds only modest cash reserves, yet the legal strategy may allow a larger recovery for consumers. Similar supply failures have affected dozens of other providers during the crisis, highlighting systemic vulnerabilities in the Czech energy market.

Why it matters

The outcome could determine how displaced energy customers are compensated when suppliers fail.
