Court of Appeal orders GISB Holdings to pay RM5,000 costs over appeal filing delay
The Court of Appeal directed GISB Holdings to pay RM5,000 in costs to the Attorney-General's Chambers after a 27-day delay in submitting its appeal record.
In a hearing before a three-member bench chaired by Datuk Mohamed Zaini Mazlan, GISB Holdings requested more time to submit its appeal record related to a Selangor fatwa. Although the bench allowed the extension, it ordered GISB Holdings to pay RM5,000 in costs to the Attorney-General's Chambers because of a 27-day filing delay. The appeal follows a High Court decision that dismissed GISB's bid for judicial review, citing Article 121(1A) of the Federal Constitution which reserves such matters for the Syariah Court.
GISB argues the challenge concerns the legality of the fatwa's issuance rather than its religious content. The case also raises questions about the applicability of a religious decree to a corporate entity.
Why it matters
The ruling highlights the procedural costs of legal delays and underscores jurisdictional limits between civil and Syariah courts in Malaysia.
