Court of Appeal overturns High Court block on Northern Ireland's A5 road upgrade

The Court of Appeal in Belfast has set aside a High Court ruling that halted the first phase of the £1.7 billion A5 road project.

Northern Ireland’s largest road undertaking, a £1.7 billion upgrade of the 58-mile A5, received ministerial approval in 2024. The High Court subsequently ruled the Department for Infrastructure’s plans failed to meet climate change requirements, following a challenge from a coalition of residents, farmers and landowners. Infrastructure Minister Liz Kimmins appealed, emphasizing her determination to complete the project.

In a Tuesday hearing, Lady Chief Justice Dame Siobhan Keegan reversed the lower court’s decision, stating the original judge erred in his approach. The appeal clears the way for the first phase of the dual-carriageway scheme, which has been delayed by legal disputes and funding uncertainty since its initial endorsement in 2007. Over 50 fatalities have occurred on the A5 since 2006, underscoring safety concerns that the upgrade aims to address.
