Court orders return of 497.82 bitcoin to nine victims of crypto fraud
A judge ruled that 497.82 bitcoin seized from wallets linked to Fadino Khairuman and Asyran Ismail must be returned to nine individuals defrauded by a cryptocurrency scheme.
In a recent ruling, Judge Arief Emran Arifin ordered the restitution of 497.82 bitcoin that had been seized from wallets associated with Fadino Khairuman and Asyran Ismail. The nine claimants had collectively placed 362.04 bitcoin into the Bitkingdom platform from 2015 to 2016 after being misled by promises of daily returns. The judge concluded that the transfers to the perpetrators' wallets constituted fraud and that the claimants never loaned the bitcoin nor incurred any debt.
Each claimant successfully demonstrated, on a balance of probabilities, that their deposits were made to Bitkingdom and that they hold a legitimate interest in the seized assets. The court will allocate the bitcoin proportionally, with individual shares ranging from 0.68% to 11.7% of the total, to Afkar Lotfi Adam, Alfiyanora Nursal, Faridah Rawi, Khairullutfi Nursal, Alif Bassari, Nazlulfarid Ramlan, Nurafiqah Che Azmi, Siti Farhana Mohamed and Khizanif Khizan.
Why it matters
The ruling shows that victims of crypto scams can recover assets through the courts, setting a precedent for cryptocurrency fraud cases.
