Court revives Title IX lawsuit accusing ENMU of enabling coach’s husband assaults
A three-judge panel of the 10th Circuit overturned a summary judgment, sending three women’s Title IX case against Eastern New Mexico University back to trial.
Three women who say they were sexually assaulted by Glen de los Reyes, husband of ENMU women’s basketball coach Meghan de los Reyes, will have their Title IX claims reconsidered after the 10th Circuit reversed a prior summary judgment. The panel held that one outlet director Paul Weir and the university could have limited Glen’s access to athletes by restricting coach-led trips, banning campus visits, and disciplining the coach, despite Glen not being a formal employee.
Internal reports indicate the university was warned about liability concerns in January 2022 and later allowed the husband to treat players at the coach’s home, where the alleged assaults occurred. The court emphasized that a school’s deliberate indifference to known misconduct can create direct liability. The case returns to lower court for further proceedings.
