Court Ruling Throws Compania de Apă Olt's Leadership and Decisions Into Doubt

A final decision by the Curtea de Apel Craiova questions the legality of Compania de Apă Olt's board appointments, prompting calls for a legal review of subsequent actions.

The Curtea de Apel Craiova issued a final judgment that casts doubt on the legality of the Consiliul de Administrație of Compania de Apă Olt. Marius Oprescu, president of the Consiliul Județean Olt, says the ruling may invalidate all administrative decisions, director nominations and contracts signed while the contested board was in place, including payments from European Union funds. He has requested a thorough legal analysis to gauge any resulting harms and to pinpoint liable parties.

The case began over a year ago when the inter-community development association ADI-OLTUL challenged the board's appointment in court, targeting the shareholders' assembly and the trade register office. Oprescu stresses that any actions taken by the allegedly illegal board could be considered null, and he plans to obtain a legal opinion from the council's attorneys while awaiting an impact assessment from the water company.

Why it matters

The ruling could overturn past decisions and financial transactions of a major regional water provider, affecting public services and EU funding.
