Defense Lawyer Outlines Multi-Faceted Plan to Avoid Retrial for Mother Accused of Killing Children

Following a Norfolk Superior Court jury’s inability to reach a unanimous verdict, defense lawyer Kevin Reddington laid out an aggressive plan to keep Lindsay Clancy from facing another jury trial. He intends to file a double-jeopardy claim, arguing that the mistrial was declared against the defense’s wishes. If that fails, Reddington will ask Plymouth County District Attorney Tim Cruz to reduce the charges to second-degree murder, enabling a bench trial and a sentencing focus on mandatory psychiatric treatment in a secure facility rather than prison.

He also seeks to replace the jury trial with a judge-only proceeding. Reddington defended his criticism of the lone dissenting juror and called for President Donald Trump to personally ask Cruz not to pursue a retrial, framing the decision as an executive matter. He admitted his earlier remarks about Cruz were excessive and expressed regret for accusing the prosecutor of not knowing the victims’ names.
