Delhi High Court orders SAP India to resume critical support for Nayara Energy

In a Monday ruling, the Delhi High Court instructed SAP India to resume all software and enterprise support it had stopped following EU sanctions on Rosneft’s stake in Nayara Energy. Justice Vikas Mahajan’s bench denied SAP’s plea to defer the order, stating that the suspension appears to breach the contractual agreement and cannot be justified by unproven sanctions. The court highlighted that the contract is subject to Indian law, which takes precedence over foreign regulations.

Maintaining Nayara’s critical software infrastructure was deemed essential given the ongoing USA-Israel war with Iran and the broader oil crisis. The refinery contributes roughly 8% of the nation’s energy, so any disruption could threaten public interest and national sovereignty. SAP argued that continuing support might expose its German parent to liability, but the court distinguished SAP India from SAP SE and found no inconvenience in restoring services.
