Democratic National Committee sues Justice Department over ballot seizure records

The DNC filed a FOIA lawsuit in D.C. federal court demanding the Justice Department disclose any plans to confiscate ballots or voting equipment before the midterm elections.

The Democratic National Committee has taken the Justice Department to court, filing a Freedom of Information Act suit in the U.S. District Court for the District of Columbia to obtain any documents concerning plans to seize ballots, voting machines, or other election materials before the upcoming midterms. The lawsuit follows the FBI's refusal to produce records after a February 6 request, which the agency later closed as “too vague.”

The DNC’s complaint references the FBI’s January raid on Fulton County, Georgia, and contends that such pre-certification seizures would undermine election security, transparency, and First Amendment rights. It also links the Justice Department’s broader push for voter-roll data to a potential pre-emptive threat to election materials. The DNC argues that the lack of response violates FOIA obligations and seeks judicial enforcement. The Justice Department has not commented on the filing.

Why it matters

The suit could force disclosure of any federal plans that might affect ballot handling before the midterms, impacting election transparency.
