DOJ Expands Lawsuit to Challenge San Jose's Gun Owner Insurance Rule

The Department of Justice filed a revised complaint against the city of San Jose, California, expanding its challenge beyond the $1,600 concealed-carry license fee to include the municipality’s liability-insurance requirement for gun owners. San Jose’s police department explains that the Gun Harm Reduction Ordinance forces firearm owners to maintain liability coverage and pay an annual fee intended to curb gun-related harm.
In the amended lawsuit, the DOJ categorises both the insurance mandate and the licensing fee as “Abusive Fees,” arguing they are presumptively unconstitutional. The move follows an earlier filing that focused solely on the licensing cost. Officials did not immediately comment on the expanded claims.
