Early retirees with children can cut retirement age under new law
Women who retired early and have children may lower their standard retirement age, provided they meet the conditions set by Law no. 360/2023.
Under Law no. 360/2023, women who have fulfilled the full contributory period and have raised children until they turned 16 can obtain a reduction in the standard retirement age. The reduction amounts to one year for two children and six months for one child, provided the necessary documentation—such as birth certificates or adoption rulings—is submitted. Those already receiving an early pension can apply the reduction when they transition to a pension based on the age limit, at which point the early-pension penalty is eliminated.
The conversion means the pension amount is recalculated without the earlier diminishment. The law also specifies that adopted children must meet the same caregiving period requirements. This provision enables eligible women to retire earlier without the financial penalty normally attached to early retirement.
Why it matters
It lets eligible mothers retire sooner without reduced benefits, improving financial security for families.
