Elder brother secures ownership of 5-bigha plot after high court rejects joint-family claim

The Madhya Pradesh High Court ruled in favor of Kailash, confirming his title to a 5-bigha 18 biswa land parcel in Morena, rejecting his brothers' claim that it was joint-family property.

A dispute over a 5-bigha 18 biswa plot in Morena was settled by the Madhya Pradesh High Court on September 25, 2026, when the bench favored Kailash, the eldest son, who held a registered sale deed dated August 20, 1998. His siblings, Vinod and Deendayal, claimed the land was bought using proceeds from their late father Shiv Narayan Sharma’s 6-7 bighas of farmland and therefore belonged to the joint family. The court emphasized that a joint-family fund must be proven with concrete evidence, which the brothers could not provide.

Kailash demonstrated that the purchase was financed by his salary and a personal loan, satisfying the legal test for self-acquired property under Hindu law. Justice Ashish Shroti noted the presumption in favor of the deed holder and affirmed the lower courts' findings, granting Kailash full title to the land.

Why it matters

The ruling clarifies how Indian courts assess claims of joint-family ownership versus self-acquired property.
