EU Court backs Ikea in fight against Vlaams Belang's immigration campaign
The European Court of Justice ruled that Ikea can oppose Vlaams Belang's use of its brand in an immigration reform proposal.
In a November 2022 presentation, the Flemish nationalist party Vlaams Belang introduced an immigration-policy package titled “Immigratie Kan Echt Anders,” abbreviating it as “Ikea” and adopting the Swedish retailer’s visual style, including its trademark and assembly-style figures. Ikea filed a lawsuit in Belgium, claiming the campaign exploited its brand for political purposes. The Belgian court referred the dispute to the European Court of Justice, which concluded that the party’s use could significantly impair the brand’s reputation and that the party had not shown that freedom of expression outweighs Ikea’s rights.
Consequently, the judges ruled in favour of Ikea, directing the Belgian court to apply the Luxembourg judgment. The decision underscores limits on political speech that infringes on commercial trademarks within the EU.
