European Court to Rule on Whether Vaud's Ex-Spouse Tax Rule Discriminates Against Women

A challenge to Vaud's tax solidarity system for former spouses has been deemed admissible by the European Court of Human Rights.

The case, brought by lawyer Raphaël Mahaim, questions whether the canton of Vaud's tax rules unfairly target women after divorce. The European Court of Human Rights in Strasbourg accepted the application, a step achieved by only about one in ten requests. Mahaim highlighted his previous success in securing a climate-related judgment against Switzerland in 2024. The court will now examine the alleged gender discrimination.

Why it matters

A ruling could reshape tax obligations for divorced women in Switzerland and set a precedent for gender-equality cases across Europe.
