Ex-wife sues late NASCAR driver’s estate for $10 million over daughter’s death

Nicole Biffle has initiated a $10 million claim against the estate of former NASCAR champion Greg Biffle, accusing him of negligence that led to their daughter Emma’s death in a fatal plane crash. According to court documents, Emma was sick on the day of the December 18, 2025 accident and had asked to stay behind, but Greg allegedly insisted she travel with him. The aircraft, which departed from Statesville Regional Airport in North Carolina, went down minutes after take-off, killing all seven passengers, including Greg and Emma.

Nicole’s petition also asks the court to freeze any further disbursements from the estate to ensure funds are available for her claim. This suit follows two earlier wrongful-death actions filed on behalf of Dennis Dutton and his son Jack, raising the total amount sought from the estate to $40 million. Greg Biffle, a 19-victory Cup Series driver from 2002-2016, was posthumously named one of NASCAR’s 75 Greatest Drivers.
