A legal claim has been filed by the son of Martin Doherty, who was murdered in a loyalist gun attack at Widow Scallan’s Pub House in Dublin in 1994. The complaint alleges that the Garda Ombudsman, Fiosrú, repeatedly declined to investigate the case despite extensive engagement and the provision of potential suspect information. The lawsuit also names Minister for Justice Jim O’Callaghan and Attorney General Rossa Fanning, asserting that the Irish state has failed to establish an effective, independent body to examine Garda misconduct and systemic failures related to the Troubles.
Pre-action letters claim the Ombudsman relies on rigid statutory limitation rules, while the Northern Ireland counterpart halted its probe after the UK Legacy Act. Advocates cite the 2024 "Policing for Peace" paper, which highlighted the absence of a systematic legacy investigative process and recommended a Historical Investigations Unit. Human-rights groups and civil-liberties organisations have echoed the call for an independent mechanism, criticizing the recent Garda Troubles Legacy Liaison Unit as insufficient. A spokesperson for Fiosrú declined to comment.
