Federal Judge Rejects Motion to Dismiss Racketeering Suit Against Defense Contractor's Spouse

In Honolulu, U.S. District Judge Leslie Kobayashi refused to grant summary judgment to Tiffany Jennifer Lam, the wife of former defense contractor CEO Martin Kao, keeping PacMar Technologies’ racketeering suit alive. Lam argued that a Hawaii state arbitration award and Kao’s federal guilty pleas should bar the civil action, but the judge highlighted that the arbitration ruling had been partially overturned by the Intermediate Court of Appeals and remained under appeal.

Additionally, because PacMar was not a party to Kao’s criminal prosecutions, his convictions could not be used as a defensive shield. The court also rejected Lam’s request to stay the case pending resolution of the state court matters, noting the lack of demonstrated hardship. PacMar’s remaining allegations include RICO violations, unjust enrichment, and civil conspiracy related to a fraudulent scheme that allegedly siphoned PPP loan money and concealed illegal campaign contributions through a fabricated scholarship organization.
