Ashley MacIsaac has discontinued his defamation action against Google after an AI-generated overview incorrectly labeled him as a sex offender.
Maritime musician Ashley MacIsaac filed a defamation claim in the Ontario Superior Court, alleging that a Google AI Overview mistakenly described him as a convicted sex offender, which led to the loss of a performance at a Nova Scotia First Nation. On July 29, his counsel submitted a notice of discontinuance, effectively ending the lawsuit, and MacIsaac declined to discuss the decision. Lawyers observing the case said the abrupt end suggests a private agreement, noting the difficulty of confronting a corporation of Google's size.
The claim argued that Google, as the creator of the AI tool, should be treated as the publisher of the erroneous content rather than a mere hyperlinker. Experts highlighted that the outcome leaves unresolved questions about AI liability, innocent dissemination defenses, and whether such AI errors could be addressed under product liability law. Google’s Canadian representative did not comment, though earlier statements indicated the problematic search results had been removed from the AI Overview.
