On Friday, the Fifth Circuit Court of Appeals confirmed the dismissal of a 2022 lawsuit that accused Jackson, Mississippi, of knowingly allowing lead-contaminated drinking water. Judge Kurt Engelhardt, appointed by Donald Trump, stated that the U.S. Constitution does not create a right to clean water or to accurate governmental disclosures in a public-health emergency. Plaintiffs argued the city's actions breached their constitutional right to bodily integrity, pointing to elevated lead levels and subsequent poisoning of children such as those of plaintiff Priscilla Sterling.
Despite evidence of long-standing infrastructure problems and delayed notifications, the court held that the claim does not invoke a deeply rooted constitutional right. The decision contrasts with water-right protections in at least nine U.S. states and several other countries, and it coincides with the Trump administration's efforts to roll back Clean Water Act regulations, drawing criticism from environmental groups.
