Former 49ers executive faces $1.4 million taxpayer kickback indictment

James Cunningham Mercurio, a former senior executive of the San Francisco 49ers, was charged with multiple felonies for allegedly steering county-funded construction contracts into a $1.4 million kickback scheme with associate McLennan.

A grand jury in San Mateo County has indicted former San Francisco 49ers executive James Cunningham Mercurio and his longtime associate McLennan on a series of white-collar crimes involving $1.4 million in alleged kickbacks from taxpayer-funded construction projects. Prosecutors allege Mercurio, who managed three county-sponsored projects after being hired in 2024, funneled contracts to McLennan, who then returned a portion of the funds to Mercurio instead of using them for the intended construction work.

The charges comprise two counts of misappropriating public money, one count of embezzlement, twenty counts of commercial bribery per defendant, and a felony forgery charge related to a fabricated performance bond. Both defendants pleaded not guilty at an Oct. 8 arraignment; Mercurio secured release on a $750,000 bond. The investigation began after subcontractors reported payment delays and questioned the authenticity of a performance bond, prompting county attorneys to uncover the alleged fraud. District Attorney Steve Wagstaffe emphasized the need for rigorous oversight of public funds, citing the case as a cautionary example of the risks of unchecked personal relationships in government contracts.
