Former Bush aide warns Supreme Court is eroding constitutional safeguards

Steve Schmidt, a former adviser to George W. Bush, argues that the Supreme Court’s recent rulings are undermining the Constitution and the rule of law.

Steve Schmidt, who once advised President George W. Bush, published a Substack essay warning that the Supreme Court is compromising the Constitution by consistently siding with Donald Trump. He points to recent rulings that have permitted the former president to pursue projects, dismiss protected officials, and dilute the Voting Rights Act. Schmidt highlights Chief Justice John Roberts’s 2005 remarks about the rule of law receding before governmental power, and argues that Roberts’s recent decisions grant broad presidential immunity, weakening practical enforcement of legal limits.

The former adviser stresses that the Constitution’s power lies in citizens and officials upholding it, not in the text alone. He cautions that if other branches fail to check abuse, legal protections may exist only on paper.

Why it matters

The column warns that Supreme Court choices could reshape how constitutional limits are enforced in the United States.
