Germany's Constitutional Court Suspends Coercive Detention of Left-Wing Activist Lina E.

The Federal Constitutional Court in Karlsruhe issued a provisional ruling that lifts the coercive detention of Lina E., a convicted left-wing extremist. The detention, ordered by the Dresden Higher Regional Court in late June, was meant to compel her testimony in the Antifa-Ost trial after she refused to speak as a witness. After the Federal Court of Justice dismissed her appeal, her attorney Erkan Zünbül submitted a constitutional complaint, which the court has not yet decided.

Recognizing significant constitutional questions, the court restored her liberty temporarily, with the order valid for up to six months. In addition to the detention, Lina E. faces a 750-euro penalty for failing to comment on offenses for which she was sentenced in 2023, including dangerous bodily injury and membership in a criminal organization. The US government classifies the German Antifa-Ost group as a terrorist organization, highlighting the broader security context.
