Hershey brings back unchanged Reese's Halloween pumpkins after winning lawsuit
Hershey announced that its classic Reese's pumpkin candies will return to stores this month unchanged, following a court dismissal of a deceptive-packaging lawsuit.
Hershey confirmed that its signature Reese's Halloween pumpkins will reappear in retail outlets this month, retaining their original smooth, oval shape, according to senior brand manager Katie DeCapria. The decision follows a lawsuit filed in 2024 that claimed the candy’s packaging was misleading because the smiling pumpkin graphics did not appear on the actual product; a judge dismissed the case in September 2025. Alongside the pumpkins, the company is rolling out its largest Halloween assortment ever, featuring 20 new items such as Hershey's cookies ’n’ creme fangs and KitKat vampire and witch shapes.
Non-chocolate options like LesserEvil pumpkin spice popcorn and cheesy corn balls will also debut with Halloween branding. Hershey noted that the pumpkin remains a core product and that Halloween spending hit a record $13.1 billion in 2025, with many shoppers beginning purchases during “summerween” celebrations.
