High Court denies college student's bid to dismiss murder charges over fatal crash

In Kuala Lumpur, High Court judge Datuk Aslam Zainuddin dismissed Danish Raman Kamar Kumaresan's attempt to strike out two murder charges linked to a fatal May 2 crash on Jalan Ampang that killed A. Doraisingam, 61, and his wife A. Menagah, 56. The judge accepted the prosecution's preliminary objection, finding the student's application procedurally defective under the Courts of Judicature Act. Consequently, the murder charges, framed under Section 302 of the Penal Code and carrying a possible death penalty or lengthy imprisonment, will be heard first in the magistrate's court and later transferred to the High Court.

Deputy public prosecutor Mohamad Fadhly Mohd Zamry represented the state, while Danish was defended by Donald Selvam. The defence had argued that applying Section 302 to a traffic accident without intent to kill violated constitutional principles.
