High Court pauses murder conviction of aspiring Uttar Pradesh candidate

The Allahabad High Court has stayed the life sentence of Nandan Lal Rai, who aims to contest the Uttar Pradesh Assembly election as an independent or possibly on a BJP ticket.

In an October 5 order, the Allahabad High Court stayed the murder conviction and life imprisonment of Nandan Lal Rai, also known as Babloo Rai, allowing him to remain free while his appeal is heard. The court emphasized that a common citizen's right to earn a living should not be outweighed by a politician's electoral ambitions, and it granted bail to Rai. He had been found guilty by a Varanasi court in April 2025 for the 2017 killing of Pramod Kumar Nigam, a member of the Ram Janmabhoomi movement that sought to build a temple at the former Babri Masjid site.

Rai's background includes association with gangster-turned-politician Mukhtar Ansari. Justices Siddharth and Vinai Kumar Dwivedi referenced Supreme Court rulings that stay convictions of elected officials, noting the special duty politicians owe to their constituencies. The upcoming Uttar Pradesh Assembly elections are slated for the first half of 2027, and Rai's counsel argued he is a BJP worker falsely implicated on suspicion.

Why it matters

The ruling highlights how legal decisions can affect political candidacy and reflects the nexus of crime and politics in India.
