ICC Prosecutor Requests Chamber to Confirm Duterte's Fitness for Trial
The ICC prosecutor has asked Trial Chamber III to rule that former President Rodrigo Duterte is medically fit to stand trial in the ongoing crimes-against-humanity case.
The International Criminal Court’s prosecution submitted a document on September 14 urging Trial Chamber III to determine that former President Rodrigo Duterte is competent to face the crimes-against-humanity charges against him. The filing, authored by ad interim Prosecutor Mame Mandiaye Niang, referenced the panel of experts’ joint and individual reports following Duterte’s medical examination. Niang stated that the court’s rules do not mandate a separate hearing on fitness and that the existing assessment, conducted more than six months ago, remains sufficient.
She added that if the Chamber wishes a reassessment, it should be carried out by the same panel to maintain continuity. The prosecutor concluded by asking the Chamber to affirm that Duterte can meaningfully exercise his trial rights and is fit for trial.
Why it matters
The decision will affect whether the former Philippine leader can proceed to face ICC charges for alleged crimes against humanity.
