Indiana Court Blocks DuPont and Corteva From Moving Assets to New Spin-off Vylor

A federal judge in Indianapolis issued a temporary restraining order that bars DuPont and its spin-off Corteva Agriscience from transferring assets to Vylor Inc., while leaving PFAS liability untouched.

The Indiana federal court’s order prevents the two companies from selling or moving any assets to the newly created Vylor Inc. Guam and fifteen states have sued, alleging a constructive fraudulent transfer. An expert cited in the case argues that DuPont became insolvent immediately after the spin-off. The ruling also specifies that PFAS contamination liabilities remain with DuPont and Corteva. The order aims to stop the alleged evasion of environmental responsibilities.

Why it matters

The freeze stops companies from sidestepping cleanup costs for PFAS contamination, protecting public health and state interests.
