Jaipur luxury resort ordered to return most of Rs 10 lakh wedding deposit

A district consumer commission ruled that Buena Vista Luxury Garden Spa Resort must refund Rs 8.5 lakh to Pardeep Gupta after his daughter's wedding was called off.

Pardeep Gupta booked Buena Vista Luxury Garden Spa Resort in Jaipur for his daughter Annie Gupta’s wedding, paying Rs 5 lakh each from his and his daughter’s bank accounts in August 2024. When the marriage was cancelled, he sought a refund, citing the resort’s promise to return the advance. The resort cited a policy that permits full forfeiture for cancellations within 60 days, but the commission noted no signed agreement contained that clause and no proof of actual loss was presented.

It held that the advance could not be retained entirely and permitted the resort to keep only Rs 1.5 lakh for administrative costs. The remaining Rs 8.5 lakh must be returned within 45 days, with interest accruing if delayed. The commission also dismissed the resort’s claim for the balance of the estimated booking amount.
