Judge Allows Parts of Defamation Suit by Emory Doctor Against CAIR Georgia to Proceed

In a decision by Judge Thomas Thrash, the Northern District of Georgia allowed key portions of Joshua Winer’s defamation lawsuit to continue. Winer, a dual-citizen surgeon at Emory, alleges that student Umaymah Mohammad’s email and subsequent media appearances accused him of aiding genocide, destroying Gaza’s health system and murdering health workers. CAIR Georgia and its affiliates reposted those claims on social media and distributed a phone script and email template naming Winer.

The court concluded that these assertions go beyond protected opinion because they imply false factual conduct. While the judge struck the purely opinion-based statements, it rejected CAIR Georgia’s bid to dismiss the remaining claims, permitting the case to proceed. The ruling focuses on whether the alleged statements can be proven false, not on the underlying political debate.
