Judge dismisses child sex abuse indictment against Timothy Busfield
A New Mexico judge granted Timothy Busfield’s motion to quash a four-count child sex abuse indictment, citing prosecutorial misconduct.
Timothy Busfield faced a February indictment in New Mexico on four counts of child sexual contact stemming from alleged misconduct with two brother actors during production of the Fox drama "The Cleaning Lady." In a hearing on Friday, Judge Joseph A. Montano accepted Busfield’s motion to quash the indictment, finding that the prosecuting attorney acted unfairly and breached grand-jury procedural rules. The judge’s order emphasized that the grand jury was treated as an extension of the prosecution, contrary to legal safeguards.
Busfield, who has denied the allegations, had a trial scheduled for May 10, 2027, but the case is now pending further prosecutorial review. A spokesperson for the Bernalillo County District Attorney’s Office indicated that officials are evaluating how to proceed. No comment was received from Busfield’s legal counsel.
