Judge Moorer Grants Plaintiff Motions, Dismisses Counterclaims in Alabama Civil Case

Judge Terry Moorer approved Jane Doe’s motions, dismissing Kelly Goff’s counterclaims and permitting an amendment to the complaint.

Judge Terry Moorer of the Southern District of Alabama ruled on pending motions in the civil suit Doe v. Goff. The court granted plaintiff Jane Doe’s motion to dismiss the defendant Kelly Goff’s breach-of-contract and unjust-enrichment counterclaims, finding they lack a jurisdictional basis and are unrelated to the federal claim. It also approved Doe’s request to amend her complaint to include a state-law tort of outrage, exercising supplemental jurisdiction under 28 U.S.C. § 1367.

The order denied the defendant’s push to fast-track his summary-judgment motion, emphasizing the court’s authority to set docket priorities. Doe has been ordered to file a second amended complaint no later than August 31, 2026. The court indicated a more detailed opinion will follow and will consider the summary-judgment motion at a later date.
