Kaczyński appeals court ruling against him in Sikorski defamation case

Jarosław Kaczyński filed a cassation appeal after a court upheld a verdict that Radosław Sikorski's comment on the Smolensk crash was lawful.

Jarosław Kaczyński lodged a cassation petition contesting a court ruling that validated Radosław Sikorski's remarks about former President Lech Kaczyński's role in the Smolensk tragedy. Sikorski noted that Kaczyński had presented the Miller Commission report as evidence, a document that confirmed the crash was an accident and ruled out a bomb plot. He argued that political discourse invents a sabotage narrative, while legal proceedings focus on the factual accident.

The March judgment dismissed Kaczyński's lawsuit, deeming Sikorski's comment a permissible assessment. Kaczyński now seeks to overturn that decision at the appellate level.

Why it matters

The appeal could affect legal standards for political speech about historic national tragedies in Poland.
