Kalshi delays Supreme Court push as it awaits regulatory guidance

Prediction-market platform Kalshi has asked the Supreme Court for a month-long extension, saying it needs more time to address amicus briefs and upcoming CFTC rules.

Kalshi, a market for event-based contracts, is seeking a one-month delay before the Supreme Court considers its dispute with states over whether its sports contracts count as gambling. The firm’s counsel, known for winning the case that struck down Trump’s tariffs, says the extension is needed to respond to amicus briefs filed the same day and to consider forthcoming Commodity Futures Trading Commission rules. Kalshi has also filed rehearing petitions asking the Sixth and Ninth Circuits to revisit recent rulings, citing the anticipated CFTC guidance.

The American Gaming Association’s spokesperson suggested the delay signals Kalshi’s anxiety about a potential loss of sports-betting volume, but the lawyer called the request a common procedural move, noting Nevada’s recent similar request. The Supreme Court must decide by January which cases it will hear this term, and the split among the Third, Sixth, and Ninth Circuits makes the case a likely candidate for review.

Why it matters

The outcome will shape how prediction markets and sports betting are regulated across the United States.
