Kituwah LLC sues Emmitt Smith, David Mosley over $2.5 million solar loan

Kituwah LLC, the investment subsidiary of the Band of Cherokee Indians, filed a complaint in Delaware Chancery Court against Emmitt Smith, David Mosley and their firm 4 13 Solutions Inc. The lawsuit alleges that the trio diverted a $2.5 million loan that was intended for a joint Texas solar farm called Project Exodus. Kituwah says the tribe provided the full investment in September 2023 and was later shut out of the venture, with no Department of Energy loan obtained and no evidence of progress shown. The complaint claims the money was redirected to settle a prior investment rather than develop the solar site.
