NCLAT orders swift IRP nomination and flags NBCC delays on Supertech projects
The NCLAT instructed the NCLT and IBBI to propose interim resolution professional candidates within a week and criticised NBCC for missing its construction-restart deadlines on Supertech’s stalled housing schemes.
In a five-page interim order, the National Company Law Appellate Tribunal expressed concern over the state-run builder NBCC’s inability to adhere to the schedule set in May 2026 for restarting construction on Supertech Ltd’s 16 stalled residential projects. The tribunal also rebuked the delay in appointing an interim resolution professional (IRP) to oversee the corporate insolvency resolution process. Accordingly, NCLAT directed the National Company Law Tribunal and the Insolvency and Bankruptcy Board of India to provide a list of potential IRP candidates within a week.
The order referenced a September 10 status report from the Apex Court Committee that documented NBCC’s challenges with several compliance conditions but offered no revised timelines. A meeting slated for September 20 is expected to fix new deadlines, and the matter will be heard again on September 25. The tribunal also ordered that missing documents from Supertech’s former management be identified and shared with counsel.
