Neurotech Breakthroughs Prompt Calls for New Rights to Guard Brain Data
Scientists have demonstrated direct visual-pattern implantation in mice, while companies push wearable brain-reading devices, leading advocates to demand legal safeguards for mental privacy.
In a Columbia lab, Rafael Yuste’s group used holographic lasers to insert visual patterns directly into mouse cortex, causing the animals to behave as if they were seeing moving bars on a screen. This proof-of-concept follows years of fMRI and AI work that can now reconstruct images, emotions and spoken language from brain activity. Commercial ventures such as Emotiv, BrainCo and major tech firms are releasing EEG-based headsets that monitor attention, stress and mood, with applications ranging from workplace productivity to neuromarketing.
As these devices move from labs to homes, the Neurorights Foundation, founded by Yuste, has drafted five “neurorights” - including mental privacy and protection from algorithmic bias - and helped Colorado and California enact the first neurodata privacy statutes. International bodies like UNESCO’s Bioethics Committee are also examining how existing human-rights frameworks might cover neurotechnology. The convergence of powerful brain-reading tools and lax regulation has raised alarms that neural data could become a new commodity, prompting urgent calls for global safeguards.
