New Jersey and Indiana adopt contrasting policies to shield consumers from AI data-center costs

New Jersey imposes statewide rate rules for AI data centers, while Indiana relies on a utility-led agreement to keep household electricity bills low.

Amid a surge in electricity demand from AI-driven computing, New Jersey and Indiana have taken opposite routes to protect ratepayers. Governor Mikie Sherrill's July legislation directs the New Jersey Board of Public Utilities to devise a separate rate for large data centers, bar the allocation of new substation or transmission costs to ordinary customers, and require centers to fund at least 85% of their requested capacity for ten years, while encouraging clean-energy and storage integration and mandating semi-annual water-and-energy reporting.

Indiana's utility commission, after negotiations involving Indiana Michigan Power, Amazon Web Services, Google and consumer groups, approved a 2025 arrangement that obliges large power users to commit financially to their service requests, enabling the utility to seek a $59 million reduction in base rates by 2027 and a three-year freeze on monthly bills, with projected savings of about $100 per year for a typical household.

Daniel Turner of Power The Future argued Indiana's model is preferable but warned that neither state ensures data centers contribute new generation capacity, urging that facilities be built alongside power plants that feed the broader grid. The White House has also promoted a Ratepayer Protection Pledge, asking major tech firms to cover the electricity needed for AI sites rather than passing costs to consumers. The debate reflects broader concerns about the United States keeping pace with China in the AI race.
